REGULATIONS FOR THE PROVISION OF ELECTRONIC SERVICES THROUGH

AUTO-WEST S.C. M. i R. PASTRYK (ECPS GROUP)


§ 1. General provisions.

1) The regulations specify the rules for the provision of electronic services via AUTO ‐ WEST S.C. M. i R. Pastryk, Żołnierska 2, 22-200 Włodawa, NIP: 565‐15‐10‐762, REGON: 060449160 (hereinafter referred to as ECPS GROUP).

2) The term Customer used in the regulations means a natural person with full legal capacity, and in the cases provided for by law, also a natural person with limited legal capacity; legal entity; an organizational unit without legal personality, which has been granted legal capacity by the provisions of the Act.

3) Services are generally provided for a fee, unless explicitly stated otherwise.

4) The cost of the service is determined individually, the Client is informed about the cost of the service before its implementation.

5) All issues not regulated in these regulations are settled on the basis of applicable law.


§ 2. Services.

1) Pursuant to these regulations, the following services are provided:

1. Answers to questions via the contact form on the website (Https://ecpsgroup.com/contact)

2. Possibility of creating, maintaining, deleting an account in the online store and concluding online sale and purchase contracts for products presented in the online store (https://shop.ecpsgroup.com).


§ 3. Technical conditions for the provision of Services.

1) In order to properly use the services, the Service Recipient is required to have computer equipment connected to the Internet and the current version of available web browsers (Mozilla Firefox, Google Chrome, Microsoft Edge or other).

2) The operation of cookies is described in the Privacy and cookie policy.

3) If the User uses hardware and software that does not meet the technical requirements specified in paragraph 1, ECPS GROUP does not guarantee the proper functioning of the website.

4) For security reasons, ECPS GROUP reserves the right to terminate the connection with the Service Recipient after 15 minutes from the time the Service Recipient made the last action on the website.

5) The data sent via the contact form and online store are protected by using secure SSL.


§ 4. Contact form on the website.

1) The contact form is available at: https://ecpsgroup.com/contact.

2) The purpose of providing the contact form is that users of the website may ask questions about products and services provided by the ECPS GROUP.

3) For any consequences resulting from improper completion of the form by the Customer, in particular consisting in providing incorrect or false data by the Customer, the Customer is fully responsible.

4)In order to use the contact form, the user provides his name, phone number and e-mail address. 

§ 5. Store on the website. 

1) The store is available at: https://shop.ecpsgroup.com.

2) The purpose of the online store is to sell products offered by the ECPS GROUP.

3) The sale is carried out in accordance with the regulations posted on the store's website.

4) The supplier of the online store is RedCart (ETK Sp. J., Uczniowska 16, 58-306 Wałbrzych, NIP: 886-294-16-15, REGON: 021180106, KRS: 0000348556).

5) ECPS GROUP also conducts online sales on other sales platforms (e.g. Ebay.com) in accordance with the rules, policies and regulations of these websites.

§ 6. Information on the processing of personal data. 

AUTO ‐ WEST S.C. M. and R. Pastryk, ul. Żołnierska 2, 22‐200 Włodawa, NIP: 565‐15‐10‐762, REGON: 060449160 as the data administrator informs that:

1) Your personal data will be processed in order to carry out daily tasks related to the functioning of the company and the company's website.

2) Depending on the category of data, the legal basis for the processing of personal data is your consent (art.6 par.1 lit.a RODO) or a contract to which the data subject is a party or to take action at the request of the data subject , before the conclusion of the contract (art.6 par.1 lit.b RODO) or a legitimate interest pursued by the administrator (art.6 par.1 lit.f RODO).

3) The recipients to whom your personal data may be transferred are state authorities authorized to process them under the law. A separate category of recipients to whom your data may be disclosed are entities authorized to service deliveries and entities with which AUTO-WEST has concluded a contract for the provision of maintenance services for IT systems used in the company.

4) In any case, your personal data will be stored for a period resulting from legal provisions or internal company regulations and procedures.

5) You have the right to access the data content and rectify it, delete or limit processing, as well as the right to object, request to stop processing and transferring data, as well as the right to withdraw consent at any time and the right to lodge a complaint to the supervisory body, i.e. the President of the Office Personal Data Protection.

6) Providing data is voluntary, but failure to provide data prevents cooperation with a company.

7) The data provided by you will not be profiled.

8) The data controller will not transfer your personal data to a third country or international organization.

9) Information on the processing of personal data can be obtained by writing to the email address: auto_west2@interia.eu.

§ 7. Protection of intellectual property.

1) The website contains content protected by intellectual property rights.

2) The Service Recipient may process them only for personal use, other forms of content use require the consent of ECPS GROUP. 

 § 8. The time of conclusion of the contract and termination of the contract for the provision of electronic services.

1) The moment of conclusion of the contract is completing and sending the contact form or making a purchase in an online store.

2) By concluding the contract, you accept these Regulations.

3) The contract for correspondence via the form is concluded for an indefinite period, each the parties may terminate it with immediate effect.

4) The terms of terminating the contract related to the functioning of the online store are set out in the store's regulations. 

 § 9. Complaints.

1) The Service Recipient has the right to submit a justified complaint in the event that ECPS GROUP fails to comply with its obligations described in these Regulations or fulfills them in a manner not in accordance with the provisions of the Regulations.

2) Complaints can be submitted by sending an email to auto_west2@interia.eu.

3) Complaints will be considered within 14 days from the date they are received in the correct form.

4) Complaints arising from the Recipient's ignorance of applicable law and these Regulations will not be considered.

5) The answer to the complaint will be given to the e-mail address provided by the Customer. 

 § 10. Final provisions.

1) The applicable law is the law of the Republic of Poland.

2) The court having jurisdiction to settle disputes is the court with general jurisdiction or the court having jurisdiction over the Service Recipient's place of residence, as well as any other court whose jurisdiction results from the legal relationship between the Service Recipient and the ECPS GROUP.

3) These Regulations shall enter into force on 23.03.2020.
